镰仓幕府首任征夷大将军源赖朝去世后，由嫡子源赖家于建久10年（1199年）正月26日继任家督，时年18岁。源赖家继任之初，即罢免后藤基清的赞岐守护一职(三左卫门事件)。后，更解除伊势神宫所领六个庄园的地头职。
建久10年（1199年）4月1日，问注所被独立设置于镰仓殿御所外，诉讼裁决不再由镰仓殿独揽大权。《吾妻镜》建久10年（1199年）4月12日条记载，源赖家不再直接裁定诉讼事件，转而由北条时政、比企能员等十三位有力御家人共同商议处理政务；外人亦不可参与诉讼裁决。
然，合议制成立后，亦有多次源赖家亲裁的纪录。例如，正治2年（1200年）5月，源赖家裁定陆奥国新熊野社的领地纠纷；6月，源赖家确认梶原景时遗孀的领地所有权；12月，源赖家欲没收御家人于治承、养和年间获封超过500町的土地，赏赐予其侧近，而后在三善康信的劝戒下才延后实施。
