澳洲聯邦憲法第三十九條指出澳洲眾議院開會時除非議會另有規定，否則應達全體眾議員的三分之一的出席（即法定人數），始得開會行使議會權力[1]。
阿得雷德辯論大會，約瑟夫·卡魯瑟斯認為原有的三分之一人數過高，建議改為二十人即足夠，但他的提議遭到否決[2]。
1989年眾議院（法定人數）法案通過後，澳洲議會將開會的法定人數減為全體眾議員的五分之一，以現今眾議員人數150人計算，亦即至少需30名參議員才達法定人數要求[3]。
