대한민국 현행 저작권법 제39조부터 제43조까지의 내용에 따르면, 대한민국의 관할 아래 있는 모든 저작물은 저작자(공동저작물은 맨 마지막으로 사망한 저작자)가 사망한 후 70년, 법인 등이 작성한 업무상저작물은 공표한 때부터 70년이 경과하면 저작재산권이 소멸됩니다. (1953년 이전에는 30년, 2013년 7월 이전에는 50년)
또한 현행 저작권법 제49조에 의해 개인인 저작재산권자가 상속인 없이 사망하거나, 법인 또는 단체가 해산되어 민법 또는 그밖의 법률에 의해 저작재산권이 국가에 귀속될 때도 저작권이 소멸합니다.

일부 국가는 저작권을 사후 70년보다 더 길게 적용하고 있으므로 주의가 필요합니다. 멕시코는 100년, 자메이카는 95년, 콜롬비아는 80년, 과테말라와 사모아는 75년을 저작권 보호 기간으로 적용하고 있습니다. 따라서 해당 국가에서 이 작품은 퍼블릭 도메인이 아닐 수 있으며, 저작권 상호주의 또한 적용되지 않을 수 있습니다.
