Basically its like saying it can and has been known to be a legal penalty just not used at this moment. I feel like this is still accurate to what I wrote. @Ohnoitsjamie: There seems to not be a consensus but jonnypedro1988 has also listed it as being penalized by remote chances of death based on the many sources spread through the article.
